The Jax.net Mining API Service Agreement (hereinafter referred to as “the Agreement”) is the applicable rights and obligations set forth by you and the Company with respect to the relevant services of Jax.net Mining API. If you wish to access and use the Jax.net Mining API and accept the services provided on this website, you should carefully read the entire contents of this Agreement. Your access to and use of the services is conditional upon your acceptance of, and compliance with, these Terms.

By accessing or using the services you agree to be bound by these terms. If you disagree with any part of the terms then you shall not access the services. You agree that you will always use your Jax.net Mining API and the services in compliance with these terms, applicable law and any other policies and standards provided to you by Jax.net Mining API.

In order to access and use the Jax.net Mining API services or register for a Jax.net Mining API Account you must be an individual of a majority age under the laws of the country you are registered and able to enter into legally binding contracts. Jax.net Mining API platform gives access to the Jax.net Mining API services or certain features of the Jax.net Mining API services platform subject to certain requirements or conditions such as completing a verification process, know your customer information or meeting specific quality/eligibility requirements.

In the event that you are accessing our site and/or site services on behalf of any incorporation, partnership, association, organization or any other entity type (“Entity”), your continued access of our site and/or site services shall constitute your representation to us that you have been duly authorized as an Entity in the Country domiciled and registered to operate such services, and perform any transactions or activities thereon, and to therefore bind your Entity to the Agreement and to any such transactions or activities that you have performed. Accordingly, when the term “you” is used herein this website, “you” shall refer not only to you the actual user as an individual, but also the Entity that you are representing, and therefore both you and the Entity are jointly and severally bound under the Agreement. Accordingly, you also hereby undertake that the Entity which you represent is capable of and agreeable to being bound by the Agreement.

We assure you that the collection of your personal data (e.g. the data submitted when creating your user account) in connection to mining with Jax.net Mining API will be as limited as possible.

Any collection, storage and handling of your personal data shall be governed by a separate set of terms on handling the personal data of our customers. Therefore, the Company recommends that you read the privacy policy entirely to better protect privacy. You agree to read, understand and accept this privacy policy as an integral part of this Agreement.

Users shall be deemed to have full civil capacity to register and/or accept the services provided by the Company. The user's acceptance of the services provided by the Company will be deemed to be the user's statement of civil capacity.

Otherwise, the user should not accept the services provided by the Company. The Company also has the right to restrict itself in providing services in cases where the user/Company does not provide KYC or participate in our customer due diligence services. The Company has the right to stop the services that have already been provided.

Once you have successfully registered and become a member of the Company, you will get the login account and password, and be responsible for all activities and events that occur after logging in to the system with this account and password.

Naming of the user and use shall comply with relevant laws and regulations and be ethical, and shall not contain any insults, threats, obscenities, defamation and others that infringe on the legitimate rights and interests of others.

The user account is dedicated to you and you are solely responsible for all activities that occur on or through your user account, so it is important that you keep your password and devices used to access the user account secure. You must bear all the legal liability caused directly or indirectly by behaviour, words and so on by using this account. Any legal consequences resulting from the disclosure of an account or password due to user reasons are the responsibility of the user. You must let us know immediately if you suspect any unauthorized access to your user account.

You are obliged to keep safe the Company account number, password or any other information bound to the account and related to the Company. You shall promptly inform the Company to reduce the losses that may occur due to replacement, suspension or termination of the use of the above information, or lose or leak the aforementioned information. Whether or not the Company has been informed, the loss caused by the above reasons shall be borne by the user.

If the password is lost, you can reset the password by registered email address. Users registered with the mobile phone number can reset the password through the mobile phone number.

You agree that any information submitted by you to be accurate, true and complete. If any of the information changes, you should update it as soon as possible to prevent any misunderstandings or problems down the line.

You agree to comply with any laws and regulations applicable to you (e.g. laws of the country where you are domiciled and registered as a Company) and do not use the Company to infringe the legitimate rights and interests of others or seek any illegitimate interests or disturb the order of functionality. We are responsible neither for obtaining such information for you, nor for compliance with such obligations.

You agree not to abuse any of Jax.net Mining API mechanisms, processes, mistakes, bugs or imperfections in programming or errors in the respective cryptocurrency network to advantage or disadvantage any person or to disrupt the operation or the availability of the Jax.net Mining API or seek any illegitimate interests or disturb the order of the transaction. By “abuse” we also mean any attempted hacking or other hostile action, such as block withholding attack, botnet attack etc.

It is forbidden to use this site to endanger national security, divulge state secrets, infringe upon the legal rights of the state’s collectives and citizens, and you must not use this site to make, reproduce and disseminate the following information in inciting resistance, undermining the implementation of the Constitution, laws and administrative regulations, inciting separatism, inciting ethnic hatred, fabricate or distort facts, spread rumours, promote feudal superstition, obscenity, pornography, gambling, violence, homicide, terror, abetment of crime, slandering others or conducting other malicious attacks and/or conduct commercial advertising activities.

You are prohibited to introduce a virus, trojan horse, worm, time bomb or other malware to the service, or use any device, software or routine to bypass any software or hardware that prohibits volume requests for information;

You are prohibited to violate, bypass or circumvent any security measure intended to limit or prevent access to the website, content or service, or otherwise attempt to gain unauthorized access to the service or any Content or to any computer systems or networks connected to the service, whether through hacking, password mining, unauthorized use of another's password/credentials or any other means;

You must not introduce or otherwise distribute through the website any computer program that damages, interferes with, intercepts, collects, releases or discloses any system, data or personal information of ours or any third party;

If there is violation any of the provisions of this article, the Company has the right to take all obligatory measures, including but not limited to deleting the content posted by the user, suspending or sealing up the user account, withholding or forfeiting any payments due from the Company, cancelling the benefits derived from the violation and even prosecuting the user for legal liability through litigation, etc. The user bears all the legal consequences arising therefrom and the loss the Company suffered is entitled to recover from the user.

The service may be resulting in delays, interruptions or terminations of the service subject to force majeure, including but not limited to natural disasters, pandemic, telecom operator regulation, computer viruses, hacking, strikes, riots, government actions, etc. for which the Company will be exempted from liability to the maximum extent permitted by laws and regulations.

Unless the Company has in clear terms agreed in writing the accuracy, completeness and reliability of any information provided by the Company to the user, obtained from the website in any way, the user is solely responsible for the risks associated with the use of the information on this website.

You acknowledge and agree that before filing any dispute or claim, you will contact us through freshdesk.support@jax.net to solve the dispute in an informal way where we will try to solve the relevant dispute internally as soon as possible. The parties agree to negotiate and solve any dispute in good faith.

Disputes should first be resolved through consultation based on the principle of good faith. If the negotiation fails, the parties shall settle disputes through arbitration. The arbitrator shall be appointed by the Company. The arbitration shall be conducted in English. The arbitrator shall, regardless of the method of arbitration, issue a reasonable written decision to explain the arbitration award and its basic conclusion. The arbitration award shall be final and binding upon the parties.

If any portion of this Agreement is held to be invalid or unenforceable, the remaining portions of this Agreement will remain in full force and effect. Any invalid or unenforceable portions will be interpreted to effect and intent of the original portion. If such construction is not possible, the invalid or unenforceable portion will be severed from this Agreement but the rest of the Agreement will remain in full force and effect.

This Agreement is an important valid legal document between the Company and the user registered as a Company user, using the Company service. If any other written or verbal meaning of the Company or the user is inconsistent with this Agreement, it shall be considered invalid and this Agreement will prevail.

You hereby agree to indemnify Jax.Money, and its affiliates, subsidiaries and its affiliates, directors, agents, officers, employees, and suppliers against any losses, action, liability, cost, claim, loss, damage, proceeding, or expense suffered or incurred from your use of the Platform and/or Service and/or from your own use or any other party’s usage with your assistance in violation of these Terms.

We reserve the right, at our sole discretion, to modify or amend these Terms of Service by posting the updated terms on the site. Your continued use of the site after any such changes constitutes your acceptance of the new Terms of Service.

Except as otherwise required by law, IN NO EVENT SHALL Jax.net Mining API, our directors, officers, members, employees or agents be liable for any direct, indirect, consequential or special damages, or any other damages of any kind, including but not limited to, loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of or inability to use our services or our platform or arising from your violation of any third party's rights.

You may terminate this Agreement at any time and for any reason by providing notice to Company in the manner specified in this Agreement or by choosing to cancel your access to the services using the tools provided for that purpose within the Services. We may terminate this Agreement without notice or, at our option, temporarily suspend your access to the services, in the event that you breach this Agreement. Notwithstanding the foregoing, the Company also reserves the right to terminate this Agreement at any time and for any reason by providing notice to you either through email or other reasonable means.

The service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of Jax.net Mining API and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without the prior consent of Jax.net Mining API.
